Newsletter Terms, Consent and Disclosure
- You are signing up voluntarily. We never add people to our list without their express, affirmative consent.
- We will only send you what you asked for. XEQT investing content and the guide you requested. Nothing unrelated.
- You can leave at any time. Every email contains a one-click unsubscribe link. No questions asked.
- We do not sell your email. Your address is never shared with or sold to any third party for marketing purposes.
- We identify ourselves in every email. Every message discloses who sent it, where we are based, and how to unsubscribe.
- This page governs your consent. By ticking the consent checkbox and submitting the form, you agree to these terms.
1. Who We Are
JustBuyXEQT.ca is operated by Kernal Media Inc., a company registered in British Columbia, Canada. We operate the website at justbuyxeqt.ca, an independent Canadian resource covering the iShares XEQT ETF.
We are the sender of all commercial electronic messages (CEMs) sent under this consent. We do not send email on behalf of any third party. All emails come from justbuyxeqt.ca.
2. Canada's Anti-Spam Legislation (CASL) and Why It Applies
Canada's Anti-Spam Legislation (S.C. 2010, c. 23), commonly known as CASL, governs the sending of commercial electronic messages to or from Canadian computers. CASL applies to every email we send that contains promotional or commercial content, including emails that promote our affiliate relationships, contain calls to action, or reference products and services even in an educational context.
CASL requires that before we send you a CEM, we must have your express or implied consent, identify ourselves clearly in every message, and provide a working unsubscribe mechanism. This page documents how we obtain and record your express consent and how we fulfil our ongoing obligations.
Our approach: We rely exclusively on express consent for our email list. We do not rely on implied consent. This means we only email people who have affirmatively ticked a checkbox and submitted the signup form. We do not pre-tick boxes, bundle consent with other agreements, or obtain consent by default.
3. The Express Consent You Are Providing
When you tick the consent checkbox on our signup form, you are providing express consent under section 10(1) of CASL to receive commercial electronic messages from JustBuyXEQT.ca / Kernal Media Inc..
3.1 Exact consent language
The checkbox label you agreed to reads:
"Yes, I want to receive the XEQT Quick Start Guide and occasional XEQT-related investing insights from JustBuyXEQT.ca. I understand I can unsubscribe at any time by clicking the unsubscribe link in any email. I have read and agree to the terms and disclosure."
This language satisfies the CASL requirement that express consent identify:
- The purpose for which consent is being sought (XEQT investing insights);
- The person seeking consent (JustBuyXEQT.ca / Kernal Media Inc.);
- The person on whose behalf consent is sought (same entity -- we do not seek consent on behalf of third parties);
- That the recipient may unsubscribe at any time.
3.2 What we record at the time of consent
For every subscription we record and retain:
- The email address provided;
- The exact consent text displayed at time of signup;
- The method of consent (express checkbox);
- Date and time of submission (UTC);
- IP address of the device used to submit;
- User agent string of the browser used;
- The page or form source from which the signup originated.
This record constitutes our CASL proof-of-consent documentation. Under CASL, the sender bears the burden of proving consent if challenged. We retain these records indefinitely unless you request deletion.
3.3 The consent checkbox is never pre-ticked
The consent checkbox on our signup form is always unchecked by default. Submission of the form without ticking the box is rejected with an error message. We do not use pre-ticked boxes, toggle switches set to "on", or any other mechanism that requires the user to take action to withhold consent rather than to grant it.
4. What We Will Send You
By subscribing, you consent to receive the following categories of email from us:
- The XEQT Quick Start Guide -- a one-time PDF download delivery email sent immediately upon signup;
- XEQT investing insights -- occasional educational and informational content about the XEQT ETF, Canadian investing accounts (TFSA, RRSP, FHSA), and related personal finance topics;
- New resource announcements -- notifications when we publish significant new guides, calculators, or tools on justbuyxeqt.ca;
- Affiliate-related content -- emails may reference or link to Wealthsimple and other platforms for which we have an affiliate relationship. All affiliate relationships are disclosed. See Section 7.
What we will not send: We will not send you emails promoting unrelated products, third-party marketing campaigns, content from other companies, or any material outside the scope of XEQT and Canadian personal investing. We will not sell or rent your email address to any third party.
We do not commit to a fixed sending frequency. Emails are sent when we have material relevant to your consent purpose. You may receive a handful of emails per year or fewer. We do not send weekly newsletters, daily digests, or promotional blasts.
5. Your Right to Unsubscribe
Under section 11 of CASL, every CEM must contain a working unsubscribe mechanism that allows the recipient to withdraw consent at any time. Our unsubscribe mechanism works as follows:
- Every email we send contains a clearly labelled unsubscribe link in the footer;
- Clicking the link immediately and permanently removes your email address from our list with no further action required from you;
- A confirmation page is displayed confirming that your unsubscribe has been processed;
- Your record in our database is marked as unsubscribed with a timestamp;
- We will cease sending you CEMs within 10 business days of your unsubscribe request -- in practice, removal is immediate.
The unsubscribe link is cryptographically secured using an HMAC token unique to your email address. It cannot be forged or used to unsubscribe another person. The link does not expire.
You may also request removal by contacting us directly at the address in Section 9. Manual removal requests are processed within 10 business days as required by CASL.
Important: Unsubscribing removes you from our email list only. It does not delete your account if you have one, does not affect cookies or tracking on the website, and does not remove your record from our consent database (which we retain for legal compliance purposes). You may request full data deletion separately under our Privacy Policy.
6. Duration and Withdrawal of Consent
Your consent remains valid and in effect until you withdraw it. Under CASL, express consent does not expire with the passage of time alone. However:
- If you unsubscribe, your consent is permanently withdrawn for that email address;
- If you do not open or interact with our emails for an extended period, we may proactively remove you from our list as a best practice, even though CASL does not require us to do so;
- If we change the scope or purpose of our email communications materially, we will seek fresh express consent before sending under the new purpose.
Re-subscribing after unsubscribing constitutes fresh express consent and creates a new consent record with a new timestamp.
7. Affiliate Relationship Disclosure
JustBuyXEQT.ca participates in affiliate marketing programs. Specifically, we have an affiliate relationship with Wealthsimple, a registered Canadian online brokerage. We may receive a commission if you click an affiliate link in one of our emails and subsequently open a Wealthsimple account.
This compensation does not influence our content. We do not recommend Wealthsimple because we earn a commission. We recommend it because it is commission-free, beginner-friendly, and genuinely suitable for the XEQT investment strategy described on this site. Our editorial position would be the same regardless of whether an affiliate relationship existed.
Every email that contains an affiliate link will include a disclosure statement identifying the nature of the relationship. This disclosure appears in the footer of every email we send.
8. Privacy and Data Handling
8.1 What data we collect
When you subscribe, we collect:
- Your email address;
- Consent metadata (see Section 3.2).
We do not collect your name, phone number, postal address, or any other personal information as part of the subscription process.
8.2 Where data is stored
Subscriber data is stored in the WordPress database of justbuyxeqt.ca, hosted on servers located in Canada or the United States. If your data is stored or processed outside Canada, it may be subject to the laws of the jurisdiction in which it is held, including lawful access by foreign governments.
8.3 Who has access
Subscriber data is accessible only to authorised administrators of JustBuyXEQT.ca. We do not share subscriber lists with any third party for any commercial, marketing, or advertising purpose. We may share data with service providers (such as an email delivery service) strictly for the purpose of sending the emails you consented to receive, under data processing agreements that prohibit secondary use.
8.4 Your rights
Under applicable Canadian privacy law (PIPEDA and BC PIPA), you have the right to:
- Request access to the personal information we hold about you;
- Request correction of inaccurate information;
- Request deletion of your personal information (subject to our legal retention obligations);
- Withdraw consent at any time (see Section 5);
- Lodge a complaint with the Office of the Privacy Commissioner of Canada.

10. Changes to This Policy
We may update this policy from time to time to reflect changes in our practices or applicable law. The effective date at the top of this page indicates the date of the most recent revision. If we make material changes that affect the scope of your consent, we will seek fresh express consent before continuing to send emails under the revised terms. Continued subscription following a non-material update constitutes acceptance of the revised policy.
